By using the services of Oskar & Stone Permanent Jewellery (“we,” “us,” or “our”), you agree to be bound by these Terms and Conditions.
These terms form a legally binding agreement between you and Oskar & Stone and govern your use of our services.
We recommend reviewing them thoroughly before proceeding.
1. Services Provided
We specialise in permanent jewellery, including bracelets, anklets, necklaces, and other custom pieces. Our jewellery is made from high-quality materials such as 925 sterling silver, 14k gold-filled options, and other durable alloys suitable for permanent wear. Services are provided at various locations across Australia, including: Public events such as festivals, markets, and pop-ups. Private bookings, including parties and corporate functions. Each piece is custom-fitted to your wrist, ankle, or neck and welded on-site by our trained professionals using a safe, precise welding process. This results in a secure, clasp-free finish intended for long-term wear. We perform all services with due care and skill, adhering to industry safety standards and best practices.
2. Event Participation
Our services are available at scheduled events or through pre-arranged private bookings. Event details—including dates, times, locations, and availability—are posted on our website and social media platforms. It is your responsibility to: Confirm event details in advance. Arrange your own transportation to and from the event. Cover any associated costs (e.g., travel, parking, or event entry fees). We strongly recommend booking in advance where possible, as availability may be limited, especially at high-demand events. We are not responsible for any inconvenience or costs arising from event cancellations or changes beyond our control (see Section 14: Force Majeure).
3. Customer Conduct and Refusal of Service
We are committed to providing a safe, respectful, and enjoyable experience for all customers, staff, and event attendees. To support this, we ask that you: Treat our staff, other customers, and event participants with courtesy and respect. Follow all instructions provided by our team during the jewellery fitting and welding process. Conduct yourself in a way that does not disrupt the event or compromise safety. We reserve the right to refuse service or request your departure from an event if you: Exhibit disrespectful, abusive, threatening, or aggressive behavior toward staff or others. Are visibly intoxicated or under the influence of drugs to a degree that impairs your ability to safely receive our services or follow instructions. Fail to comply with safety protocols, posing a risk to yourself, our staff, or others. Breach event-specific rules or regulations set by the organisers. Our staff are trained to assess these situations fairly, prioritising safety and service quality. This right to refuse service is exercised reasonably, in accordance with Australian law, and does not affect your statutory consumer rights under the Australian Consumer Law (ACL).
4. Payment Terms
Payment Timing: Full payment is required at the time of service, before the jewellery is welded. Accepted Methods: We accept cash, credit/debit cards, afterpay and other payment methods as indicated at each event (e.g., mobile payment apps). Check event signage or staff for specifics. Pricing: All prices include GST where applicable and are quoted in Australian dollars (AUD). Prices may vary based on material choice, design complexity, or event-specific offerings. Adjustments: We reserve the right to modify prices or offer promotional discounts at our discretion. Changes will be communicated where feasible, though event-day pricing applies. Refunds: Our refund policy complies with the Australian Consumer Law (ACL). See Section 6 and our Refund Policy for details.
5. Warranty and Liability
Weld Warranty: We offer a 14-day warranty on the weld. If the weld breaks due to a manufacturing defect within 14 days of purchase, we will repair or replace it at no cost, provided: You present proof of purchase (e.g., receipt or booking confirmation). You notify us of the issue within the 14-day period. Exclusions: The warranty does not cover: Damage to chains, charms, or components due to misuse, accidents, or normal wear and tear. Breakage caused by excessive force, improper handling, or external factors (e.g., catching on objects). Quality Assurance: Each piece is strength-tested by our staff before you leave the event to confirm it meets our standards. By accepting the jewellery, you acknowledge its condition at the time of purchase. Liability Limitation: Our liability is limited to the cost of the service provided, except in cases of gross negligence or willful misconduct. We are not liable for: Allergic reactions, skin irritation, or health issues related to materials or the welding process, unless caused by our negligence. Injuries or damages resulting from misuse or failure to follow care instructions. Re-Weld Service: If your jewellery weld breaks after the warranty period—or for jewellery not originally purchased from us—we offer a re-weld service for a fee of $25, subject to availability at events.
6. Consumer Rights
Nothing in these Terms overrides your statutory rights under the Australian Consumer Law (ACL) or other applicable legislation.
You are entitled to: Services performed with due care and skill. Products of acceptable quality and fit for their intended purpose. If we fail to meet these standards. Minor Issues: We may repair the item at our discretion. Major Failures: You may choose a refund or replacement, as per ACL guidelines. Contact us to discuss remedies if you believe your consumer rights have been breached.
7. Safety and Procedure
Our welding process is conducted by trained professionals using safe, industry-standard equipment. While risks are minimal, potential hazards include: Slight skin irritation or discomfort from the welding spark. Rare instances of minor burns if safety instructions are not followed. To minimise risks: Inform us of any allergies (e.g., to metals), skin sensitivities, or medical conditions before the procedure. Follow all safety instructions provided by our staff. By proceeding with the service, you acknowledge these risks and accept them, provided they are not due to our negligence. We are not liable for health-related issues unless caused by our failure to exercise due care.
8. Event Rules and Regulations
You must adhere to all rules and regulations set by event organisers, which may include: Health and safety protocols. Dress codes or entry conditions. Behavioral expectations specific to the venue. Non-compliance may result in refusal of service or removal from the event. We are not responsible for any consequences or costs arising from your failure to follow these rules.
9. Privacy
We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). We collect data such as your name, contact details, and payment information to:Provide and improve our services. Process bookings and payments. Send marketing communications (with your consent). By using our services, you consent to this data collection and use. You may access, correct, or request deletion of your data by contacting us. We take reasonable steps to protect your information but are not liable for breaches beyond our control (e.g., third-party cyberattacks).
10. Intellectual Property
All content related to Oskar & Stone—including designs, logos, website materials, and promotional content—is our intellectual property, protected under Australian law. You may not reproduce, distribute, or use these materials without our written permission, except for personal, non-commercial purposes (e.g., sharing a photo of your jewellery with credit to us).
11. Social Media and Photography
We may photograph or film our jewellery and customers at events for marketing purposes, such as social media posts, website features, or advertisements. By participating in our services, you consent to the use of your image unless you explicitly opt out at the time of service. If you opt out, we will make reasonable efforts to exclude you from promotional materials, though we cannot guarantee complete exclusion in group settings.
12. Governing Law and Dispute Resolution
These Terms are governed by Australian law, with disputes subject to the jurisdiction of Australian courts. If a disagreement arises: Contact us first to seek an informal resolution. If unresolved, we may pursue mediation before escalating to legal action, in line with Australian dispute resolution practices.
13. Amendments
We may update these Terms as needed to reflect changes in our operations or legal requirements. Updates will be posted on our website, and your continued use of our services constitutes acceptance of the revised terms. Check this page periodically for the latest version.
14. Force Majeure
We are not liable for delays, cancellations, or failures to provide services due to events beyond our reasonable control, such as: Natural disasters (e.g., floods, bushfires). Pandemics or government restrictions. Severe weather or power outages. In such cases, we will attempt to reschedule services or offer refunds where feasible, but we are not responsible for additional costs or losses you may incur.
